Assumption of risk and release

Trips can include activities with real risk, including:

• Hiking on uneven, wet or steep terrain
• Swimming, paddling or other time on or near water
• Weather, heat, cold, insects, wildlife and plants
• Travel by car, van, boat or plane
• Being far from medical care
• Shared lodging, food prepared for the group, and the actions of other guests

Some of these risks cannot be removed, even when everyone is careful.

• You are 18 or older.
• You have told us about any medical condition, allergy or limitation that could affect your safety or the group’s.
• You will follow the host’s safety instructions and the code of conduct.
• You choose which activities to join and can sit out any activity.

You understand the risks described above and choose to take part. You accept responsibility for risks that are part of the activities themselves.

To the extent the law allows, you release Always Funday LLC, its owners, hosts and contractors from claims for injury, illness, loss or damage arising from the inherent risks of the trip. This release does not cover harm caused by our gross negligence or intentional misconduct, or anything the law does not allow a release to cover.

If you need medical care and cannot decide for yourself, you authorize the host to arrange it and to contact your emergency contact. You are responsible for the cost of your medical care.

Hosts may take group photos. We only post a photo of you with your permission, and you can say no at any time.

Minnesota law governs this agreement. If part of it is found unenforceable, the rest still applies.
