Terms of Service — v1.0
The deal between us
These terms are the agreement between you and Always Funday LLC. We've kept them as readable as we can, but they're a real contract — please read them. By creating an account or using Always Funday, you agree to them.
1. Who can use Always Funday
You must be at least 18 years old and able to enter a binding contract. When you create an account you agree to provide accurate information, keep your login secure, and be responsible for everything that happens under your account.
2. Our role: we're the platform, not the host
Always Funday is a platform that connects organizers with people who want to attend their events. Organizers create, run, and are responsible for their own events. We don't host, supervise, or control what happens at an event, and we aren't a party to any agreement between an organizer and an attendee. We don't endorse or guarantee any event, organizer, or member.
3. Community Standards apply to everyone
Your use of Always Funday is also governed by our Community Standards, which are part of these terms. In short: be respectful, act in good faith, and don't harm other people. Behavior that violates the standards can cost you your account.
4. Organizer obligations
If you run events, you agree to:
- Describe your events honestly and deliver what you advertise.
- Follow all applicable laws, obtain any permits or insurance your event requires, and keep your attendees safe.
- Handle attendee information responsibly and only for running your events.
- Understand that paid tickets follow Always Funday's platform-wide Refund Policy, including self-service refunds up to 48 hours before your event starts.
You are solely responsible for your events. You agree to indemnify and hold Always Funday harmless from any claims arising out of events you organize.
5. Payments and fees
Payments are processed by Stripe, subject to Stripe's own terms. For our services:
- Organizer subscription: hosting events requires a subscription of $150 per year. It renews automatically until you cancel; you can cancel any time and keep access through the end of your paid period.
- Platform fee: for paid events, Always Funday retains a 4% platform fee on ticket sales. The organizer receives the remainder, less Stripe's processing fees.
Fees are non-refundable except where required by law or stated otherwise.
6. Refunds
Paid events follow our platform-wide Refund Policy: you can get a full, self-service refund up to 48 hours before an event starts, after which refunds are closed except at our discretion. Organizer subscription fees are non-refundable once a billing period begins. Where the law grants you a stronger refund right, that law applies.
7. Assumption of risk for in-person events
This is important. Always Funday's product is people meeting in person. Attending or hosting an event carries inherent risks, and you take them on voluntarily. You understand and agree that:
- We do not vet, background-check, or supervise organizers or attendees, and we make no guarantees about anyone you meet through the platform.
- You are responsible for your own safety and for using good judgment before, during, and after any event.
- Always Funday is not liable for injuries, losses, disputes, or damages that occur at or because of an event.
8. Content you post
You keep ownership of the content you post, but you grant Always Funday a license to display and distribute it as needed to operate the platform. Don't post anything unlawful, infringing, or in violation of our Community Standards. We may remove content that breaks these rules.
9. Suspension and termination
You can close your account any time. We may suspend or terminate an account that violates these terms or our Community Standards, creates risk for others, or misuses the platform. When it's practical and safe to do so, we'll tell you why.
10. Disclaimers and limitation of liability
Always Funday is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Always Funday LLC is not liable for any indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
11. Disputes and governing law
These terms are governed by the laws of the State of Minnesota. Any dispute will be handled in the state or federal courts located in Minnesota, and you agree to that jurisdiction. We'd always rather resolve things directly first — email us.
12. Changes to these terms
We may update these terms as the platform grows. If we make a material change, we'll update the version and date above and, where appropriate, notify you. Continuing to use Always Funday after a change means you accept the updated terms.
